Prior to signing the contract
Prior to signing a contract with your builder, we can assist you with:
- advising you on Housing Industry Association (HIA), Master Builders and Queensland Building and Construction Commission standard form contracts including key commercial risks;
- advising you on price increases, or items that may increase the contract price based on our experience acting for homeowners and builders; and
- negotiating special conditions.
After signing the contract
After you sign the Contract, the wheels start moving on your construction work. So we can advise homeowners in respect of:
- invoices or payment claims issued under the contract and making sure that the work being claimed for is complete;
- recommendations in relation to staged inspections;
- reviewing and responding to claims for variations, extensions of time and latent conditions/unforeseen circumstances;
- breaches by the builder in the carrying out of the works and issuing appropriate notices
- terminating the contract if the builder fails to remedy breaches;
- assisting in lodging claims under the QBCC Home Warranty Scheme;
- reviewing any rejected claims under the QBCC Home Warranty Scheme.

After Practical Completion
After your home has reached practical completion, there is usually a 12 months defects liability period for non-structural defects under the Contract. The QBCC also has a statutory insurance scheme where non-structural defects are covered for six months
We can assist you in preparing correspondence to the builder and the QBCC in relation to placing them on notice of defects that may exist. If the builder fails to rectify, the QBCC will carry out an inspection and determine whether works are defective. if they are, the QBCC will direct the builder to rectify it or have another builder carry out rectification work at the original builder's expense.
